Terms and Conditions of the In Memorio portal

These terms and conditions define the rules for using the In Memorio memorial portal — a place where users can commemorate the deceased by creating profiles, leaving memories, lighting virtual candles, and placing flowers.

§ 1

General Provisions

1.1. The operator of the In Memorio portal (hereinafter: “Portal”) is the In Memorio team.

1.2. The Terms and Conditions define the rights and obligations of Users and the rules for the provision of electronic services.

1.3. Use of the Portal implies acceptance of the provisions of the Terms and Conditions and the Privacy Policy.

1.4. The Portal is commemorative and cultural in nature. Content must respect the dignity of the deceased and their loved ones.

§ 2

Scope of Services

2.1. In the Portal, the User can utilize the following services:

  • viewing memorial profiles of the deceased,
  • creating their own memorial profiles after creating an account,
  • adding memories, photos, and biographies,
  • lighting virtual candles and placing flowers,
  • utilizing supplementary (Premium) services.

2.2. Basic services are free. Premium services are paid and described in § 7.

§ 3

Account Registration

3.1. Account creation requires an email address, a password, and a display name.

3.2. An account can be created by a legal adult or by a minor with the consent of a legal guardian.

3.3. The User agrees to provide true data and to maintain the confidentiality of their password.

3.4. The User can delete their account at any time by contacting support. Deleting an account does not result in the automatic removal of created memorial profiles if they serve to commemorate the deceased.

§ 4

Memorial Profiles

4.1. A memorial profile can be created by a person close to the deceased (family, friend) or an authorized person.

4.2. The profile contains: first and last name, dates, photos, biography, epitaph, and gallery.

4.3. All profiles are public and visible even to those without an account — remembrance must be open.

4.4. The profile creator is responsible for the accuracy and legality of the data entered, including holding consent for the publication of photos and images.

4.5. In case of a dispute over a profile (e.g., reports from family), the Operator reserves the right to temporarily hide the profile until the matter is clarified.

§ 5

User Content

5.1. By publishing content (memories, photos, biographies, comments), the User declares they hold full rights to it.

5.2. It is forbidden to publish content that is:

  • offensive, vulgar, damaging to the dignity of the deceased or their loved ones,
  • inciting hatred, discrimination, or violence,
  • advertising, spam, and commercial content without the Operator's consent,
  • violating copyrights and third-party rights,
  • false or misleading.

5.3. The User grants the Operator a non-exclusive, royalty-free license to display the content entered within the Portal.

§ 6

Moderation

6.1. The Operator reserves the right to moderate content — both preventively and upon a User's report.

6.2. Content violating the Terms and Conditions may be hidden or removed without notice.

6.3. Every User can report inappropriate content by contacting Portal support.

6.4. In case of serious or repeated violations of the Terms and Conditions, a User's account may be suspended or deleted.

6.5. The User has the right to appeal a moderation decision within 14 days.

§ 7

Premium Services and Payments

7.1. Paid services (Premium) are available on the Portal, in particular:

  • lighting a premium candle (with longer duration and distinctive appearance),
  • placing a premium flower bouquet,
  • additional space for photos in the profile gallery,
  • featuring a memorial profile.

7.2. Virtual candles and flowers left on the profile are visible for 7 days from the moment of lighting / placing, after which they are automatically removed from the active list. Premium candles and flowers may have extended visibility times indicated at the time of purchase.

7.3. Prices for Premium services are indicated in Euros (€) or local currency and include VAT.

7.4. Payment is made through an electronic payment provider. The Operator does not store Users' payment card data.

7.5. Pursuant to Art. 59(o) of the Consumer Code (or local equivalent), the right of withdrawal does not apply to digital content provided immediately after payment (e.g., lighting a candle), for which the User expresses consent by placing the order.

7.6. Complaints regarding payments and Premium services should be addressed to support within 14 days of the service provision. The Operator handles complaints within 14 working days.

§ 8

Copyright

8.1. By entering content into the Portal (texts, photos, biographies, memories), the User declares they are the author or possess the necessary authorization for their publication.

8.2. The User grants the Operator a non-exclusive, royalty-free, and perpetual license to use the content entered within the scope necessary for the Portal's operation.

8.3. By entering the image of a deceased person, the User declares they have consent for the publication of that image or that publication is permitted by law.

8.4. The Operator does not claim copyrights to content entered by Users. Such content remains the property of its creators.

§ 9

Personal Data Protection

9.1. The Controller of Users' personal data is the Portal Operator.

9.2. Personal data are processed in accordance with the GDPR and applicable national laws.

9.3. Data collected include, in particular: email, display name, content entered by the User, and payment data.

9.4. Further details are contained in the Privacy Policy available on the site.

§ 10

Liability

10.1. The Operator acts with due diligence to ensure the Portal's functioning but does not guarantee uninterrupted access or the total absence of malfunctions.

10.2. The Operator is not responsible for content entered by Users or for interruptions due to force majeure.

10.3. The User is fully responsible for the content published and for any violations of third-party rights.

§ 11

Final Provisions

11.1. The Terms and Conditions are valid from the date of publication.

11.2. The Operator reserves the right to change the Terms and Conditions at any time.

11.3. For anything not regulated by these Terms, the current Italian laws apply.
